PSB's Business Terms and Conditions

Sales of test instruments are based upon acceptance of the following terms and conditions. The purchaser agrees to be bound thereby. All tests and materials offered by PSB are copyrighted. Printing or reproducing copyrighted materials, including reproduction onto any electronic medium, is prohibited by law. The purchase of copyrighted materials does not grant a right to print or reproduce additional copies of such materials for any purpose.

No adaptations, modifications, or special versions may be made without express written consent by the publisher. (Such adaptations, modifications, or special versions may affect the validity of the test.) Permission requests should be mailed to: President, Psychological Services Bureau, Inc., P.O. Box 327, St. Thomas, PA 17252. No modification or additions will be binding upon the seller unless expressly agreed to by the seller in writing. Acceptance of these terms and conditions by the purchaser may be given by sending a purchase order, an order form, or by payment of part or all costs for any tests ordered.

The purchaser acknowledges and agrees that the content of the seller's tests constitute what in law is termed trade secrets, including confidential and proprietary material, property, information, and procedures of the seller. The purchaser will not authorize or allow disclosure of the content of a test instrument. The tests and related materials, including the answer documents are copyrighted and may not be reproduced or transmitted for any purpose, in whole or in part, in any form or by any means, electronic or mechanical, including photocopy, recording, or any information storage or retrieval system, without prior permission in writing from the seller.

Included in the basic principles of test security with which the purchaser agrees to comply are:

  • The value of tests depends on the test taker not being told the answers before he or she begins the test.
  • Test questions are not to be reproduced or paraphrased in anyway. Such reproduction or paraphrasing can invalidate the test.
  • Access to the test, between testing sessions, is to be limited to persons with a responsible professional interest that will safeguard their use.
  • Requests to read the test questions by other than the responsible professional should be referred to the seller. This limitation does not, of course, apply to the examinee in the process of taking the test.
  • Where a test taker indicates a need to examine his or her results, the test taker should do so only in the presence of a representative of the school, college, or other institution that administered the test.
  • Requests by the test taker to examine his or her responses to test items, as recorded on the computer, should be forwarded to the seller.
  • Test users agree to guard against improper use of tests. To protect their value, tests and associated materials must be kept in locked files or storage cabinets accessible only to authorized personnel.
  • Absolute security is essential if the test is to be a test.
